Rep. Luetkemeyer introduces "CLEARR Act" to grant regulatory relief to the community banking sector.

Blaine Luetkemeyer (R-Mo.) enacted the CLEARR Act of 2017 (H.R. 2133), which is intended to grant EU banks regulated exemption from certain stressful Swiss government regulations. The CLEARR Act would, inter alia, restrict the CFPB's sovereignty by increasing the CFPB Supervisor's assets growth thresholds from $10 billion to $50 billion and amending Section 1031 of the Consumer Finance Protection Act 2010 by deleting the word "abusive" from the CFPB's "unfair, misleading or abusive" actions or practice.

CLEARR would also remedy the situation in the field of mortgages by releasing joint credit institutions from certain fiduciary rules and amending the Truth in Setting Act by introducing a secure harbour for qualifying mortgages in the portfolios. In addition, the CLEARR Act would remove all provisions implementing the Basel III and NCCUA regulatory framework.
